By accessing or using Foundation ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use the Service. Foundation is a construction management platform operated by Foundation Software LLC ("we," "us," or "our").
Foundation provides cloud-based construction project management software for custom home builders, including but not limited to project scheduling, budgeting, draw management, contract management, client portals, and communication tools. The Service is provided on a subscription basis.
To use the Service, you must create an account and provide accurate, complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use.
Foundation offers a 14-day free trial. After the trial period, your subscription will automatically convert to the paid plan selected during signup. The monthly plan is a $199 subscription plus an $8 recurring Subscription Service Fee, for a total of $207/month. The annual plan is a $2,200 subscription plus an $80 recurring Subscription Service Fee, for a total of $2,280/year. The service fee applies regardless of payment method and appears as a separate line on Stripe invoices and receipts. Payment is charged automatically to the payment method on file. You may cancel at any time, and your access will continue until the end of the current billing period. No refunds are provided for partial billing periods.
We reserve the right to change pricing with 30 days' written notice. Price changes will take effect at the start of your next billing cycle.
You may cancel your subscription at any time through your account settings or by contacting support. Upon cancellation: (a) your access continues until the end of the current billing period; (b) no further charges will be made; (c) your data will be retained for 30 days after cancellation, after which it may be permanently deleted.
You own your data. All project data, documents, photos, contracts, and other content you upload or create using the Service remains your intellectual property. We do not claim ownership of your content. You grant us a limited license to store, process, and display your content solely for the purpose of providing the Service.
Upon account termination, you may request an export of your data within the 30-day retention period.
The Service, including its design, code, features, documentation, and branding, is the intellectual property of Foundation Software LLC. You may not copy, modify, distribute, or reverse-engineer any part of the Service. Your subscription grants you a non-exclusive, non-transferable license to use the Service for your business purposes.
Certain features of the Service use artificial intelligence ("AI") to generate estimates, cost projections, suggestions, and responses, including but not limited to the AI Estimate tool and the AI Support Assistant.
AI-generated content is provided as a convenience only and may contain errors, inaccuracies, or omissions. You acknowledge and agree that:
THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY LAW, FOUNDATION SOFTWARE LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES.
Foundation is a project management tool and does not guarantee the accuracy of scheduling, budgeting, financial calculations, or AI-generated content. You are responsible for verifying all project data, contract terms, financial figures, and AI outputs. Our total liability shall not exceed the amount you paid for the Service in the 12 months preceding the claim.
You agree not to use the Service for any unlawful purpose, to upload malicious content, to attempt to gain unauthorized access to other accounts, or to interfere with the Service's operation. We reserve the right to suspend or terminate accounts that violate these terms.
We may update these Terms from time to time. We will notify you of material changes via email or in-app notification at least 14 days before they take effect. Continued use of the Service after changes become effective constitutes acceptance of the updated terms.
These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be resolved in the courts of Bexar County, Texas.
